The Brown decision and the Civil Rights Act addressed specific types of discrimination without fully addressing : 1) the vestiges of discrimination, including then-existing disparities in wealth or education which certainly impacted future prospects for both employment and education; 2) the vestiges of discrimination, including unconscious “baggage” (unconscious bias) which unknowingly impacted (and continues to impact) education and employment; and 3) schemes designed to discriminate using a pretext or proxy for race or ethnicity, which also impacts education and employment.
