Duties
- The incumbent serves as Assistant General Counsel for Investment Management within the Legal Policy Group of the Office of the General Counsel. The focus of the work is principally on questions in the investment management area, regarding investment adviser and investment company matters. The incumbent is responsible for supervising a program that provides high level legal assistance. Such work generally pertains to matters which are of the highest level of complexity, involve precedent-setting legal issues, and that have a significant impact on the administration of the securities laws.
- Provides advice on novel legal questions and responds to substantive questions concerning the Investment Advisers Act of 1940 and the Investment Company Act of 1940, and other areas of law, such as administrative law. Reviews and analyzes proposals for rules and regulations drafted by other Offices or Divisions of the Commission, particularly from the Division of Investment Management, and assists in providing advice on enforcement recommendations raising investment management issues.
- Addresses extremely complex and difficult matters involving investment adviser and investment company regulation. Interprets regulations, orders, legislation, decisions, opinions or other legal instruments, provides authoritative advice and assistance to other attorneys whose work has broad legal implications and may require anticipation of the development of law in order to formulate policy alternatives, and analyze the legal aspects of such alternatives, consistent with the development of law.
- Directs attorneys within the Office and is responsible for planning, organizing and supervising work production to meet deadlines and maintain quality. The incumbent has authority to review, accept, amend, or reject work of subordinates. The incumbent is also responsible for keeping employees informed regarding the policies, procedures, and goals of the Commission as they relate to their work on assigned projects. Plans, organizes, and carries out projects independently, keeping supervisors apprised of the status of those projects and major problems encountered.
Qualifications
- D. or LL.B. degree
- Active membership of the bar in good standing in any state, territory of the United States, the District of Columbia, or the commonwealth of Puerto Rico. (Note: proof of bar membership will be required before entry on duty.)
