The Office of the Attorney General is looking for an enthusiastic and motivated attorney to join the Non-Profit Organizations/Public Charities Division.   The Division is responsible for protecting and promoting the public’s interests in the Commonwealth’s public charities that range in size and complexity from our largest universities and health care systems to small, local human service organizations.

Primary Duties: The successful candidate will participate in the investigation and enforcement of civil charity laws and fiduciary standards that: (a) prohibit fraudulent or

deceptive charitable fundraising; (b) protect the public from misapplication of charitable funds in matters involving complex issues of corporate, trust, and federal tax law; and (c) require registration and financial reporting by charitable organizations and fundraisers.

The successful candidate’s responsibilities will include: negotiating with charitable organizations and, if necessary, initiating litigation to prevent wrongful self-dealing, conflicts of interest, and misappropriation of funds; participating in matters involving statutory notice of significant transactions, corporate dissolutions and windups, and court approvals of changes in uses or purposes of charitable funds; and responsibility for handling charitable bequests in wills and charitable trusts under wills.

Position Requirements: Applicants must have excellent written and oral communication skills, strong academic credentials, a minimum of three years litigation experience, a commitment to working for the public interest, and be a member in good standing of the Massachusetts bar. A general knowledge of charities law, fiduciary standards, and the ability to review financial statements is preferred. Experience with the Probate Court process and the MUTC, MUPC, and experience in and/or an aptitude for financial analysis are a plus.
